Man fined €1,000 for seriously injuring driver in head-on crash
A 34-year-old man from Zejtun was this afternoon fined €1,000 after grievously injuring Christian Mercieca in a head on crash back in July 2009 in Marsascala Road, Zabbar.
In her decree, Magistrate Edwina Grima decided that David Spina and Christian Mercieca were both to blame for the accident as they had not kept a proper lookout.
Spina had seriously injured Mr Mercieca when in an attempt to avoid a cyclist; he veered off the same carriageway and crashed into Mercieca’s vehicle on the opposite side of the road.
However, taking the witness stand, Mercieca and Spina both declared that neither driver had done anything wrong whilst driving and admitted that despite driving in broad daylight and with no other obstacles, they did not see each other and crashed.
Furthermore, Magistrate Grima held that the road where the accident occurred was straight and neither driver braked.
Despite being acquitted of driving dangerously and subsequently injuring Mercieca, David Spina was fined €1,000 after Magistrate Grima claimed that he had been driving carelessly at the time of the incident.
Moreover, the Magistrate decided against suspending the license of Spina.
