Teacher, school to pay €290,000 compensation to former student
Bambi playschool and a teacher were today ordered to pay compensation amounting to €290,000 after a child of five years had fallen down the height of one storey after his class was left unattended.
The accident happened in January 1998 when the teacher left the classroom to collect some papers from an office downstairs. The child walked out of the classroom and stood on a chair to look down to see whether his teacher was coming as he needed to go to the bathroom. In the process he slipped and fell the height of one story suffering head injuries that left him with a permanent disability of 80 per cent.
The school was found to have been inadequate to prevent children from injuring themselves while the teacher was blamed for leaving the class unattended while collecting some papers. Thus the court ordered the school to pay 75 per cent of the compensation and 25 per cent by the teacher. In reaching the compensation amount, the court took into consideration the disability suffered by the child and the assistance he will require in the future.
